UTV Terms and Conditions

1. UTV, including UTV apps and UTV box, is a platform provided by China Mobile Hong Kong Company Limited ("CMHK") and its affiliates(collectively known as "UTV Platform"). Visitors and/or registered users (collectively known as the "User(s)") who use UTV Platform shall refer to these terms and conditions (the "Terms and Conditions").

2. UTV Platform has the following features:

(i) free or paid Internet streaming video viewing services;

(ii) personalized services for the Users;

(iii) live playback function; and

(iv) all features, websites, User interfaces and services related to all content and software of UTV Platform.

(collectively known as the "Services")

3. The Users can use UTV Platform through the use of designated televisions, computers and other devices connected to the Internet (the "Supported Devices").

4. By accessing and using the Services, the Users agree to be bound by the Terms and Conditions and their updated versions from time to time.

5. Registered users

5.1 The Users can create their own accounts by providing their mobile phone numbers to become registered users of UTV Platform (the "Registered Users").

5.2 The Registered Users shall ensure the authenticity and integrity of the personal information and keep the personal information up to date.

5.3 The Registered Users are solely responsible for maintaining the security of their accounts of UTV Platform.

5.4 The Service is only available to the Registered Users through a single supported device.

5.5 The Registered Users must legally use the accounts of UTV Platform and be responsible for all activities in their accounts.

5.6 To maintain control of the accounts and prevent anyone from accessing the accounts, the Registered Users shall have control of the Supported Device and shall not disclose any password or SMS verification code required for accounts login to anyone. The Registered User is responsible for providing CMHK with the relevant information of the accounts in verifying the identity of the accounts.

6. The Services

6.1 The Users must be 18 years of age or older. Persons under the age of 18 should be accompanied by their legal representatives when using the Services and are willing to comply with the Terms and Conditions.

6.2 Some services are fee-based services (the "Charged Services"), and the Users need to complete the payment through third-party payment gateways (such as App Store and Google Play) or CMHK bill payment to enjoy the Charged Services.

6.3 All Charged Services have an expiration date. The Users must use the Charged Services within the validity period. Under no circumstances can the Users request a refund for reasons other than the causes made by CMHK.

6.4 Once the Users has acquired the Paid Service, it cannot be exchanged, refunded, sold, split, transferred or assigned to another person.  Further, the Charged Services of different Users cannot be combined. When the User terminates his/her account, the Charged Services shall be automatically cancelled and CMHK shall not provide any compensation.

6.5 When the User has paid the fee for the Services to CMHK, CMHK shall not refund or exchange any fees paid for other products or services under any circumstances, including but not limited to discontinuance or suspension of the Services.

6.6 If CMHK is unable to collect relevant fees from a third party payment portal, CMHK reserves the right to suspend the use of relevant Charged Services until CMHK successfully collects the relevant fees and re-provides the relevant Charged Services on a date that CMHK deems appropriate.

6.7 If the User purchases the Charged Services through a third party payment portal, the User is deemed to have read and agreed to the Terms and Conditions. CMHK makes no representations or endorsements as to the reliability or performance of the software, applications, media platforms, devices or services provided by any third party payment portal, nor shall it be liable for any damages, losses and/or expenses that may be caused by the User as a result of using the relevant third party payment portal.

6.8 CMHK shall not be liable for any loss or liability arising from CMHK's inability to provide Charged Services or any problems in the provision the Charged Services due to following reasons:

(i)the User's lost account, blocked or frozen account;

(ii) the information is disclosed by the User for accessing the account to the others；

(iii) the account of a third party payment portal bound by the User;

(iv) the User's intentional or gross negligence or violation of laws; or

(v) the User's own reasons.

6.9 CMHK reserves the right of final decision on the validity of the Charged Services.

6.10 The contents of the Services to the Users are for personal use only and not be used for commercial purposes. CMHK grants the Users a limited, non-exclusive and non-transferable right to use the UTV Platform to obtain Services. Notwithstanding any provisions in the Terms and Conditions, CMHK does not transfer any rights, ownership or interest to Users.

6.11 The Supported Devices for the Services may be updated from time to time, please pay attention to the related announcement.

6.12 The Users may be required to update the version of the UTV Platform from time to time in accordance with relevant requirements to enable the Users to continue to use the Services.

6.13 The image quality and smoothness of the Services display may vary depending on the different Supported devices and may be affected by various factors, such as the User's location, available bandwidth and/or network connection speed.

6.14 The Users may incur mobile data charges for using the Services via mobile networks and are responsible for checking with the relevant mobile service providers for details.

7. Users' Obligations

7.1 Users should read all relevant terms and conditions before using the Services, including but not limited to the Terms and Conditions. By using the Services, the Users are deemed to have read, understood and agreed to the Terms and Conditions.

7.2 All copyrights, patent, trademarks, any other intellectual property rights, proprietary rights or business secrets in the content and information contained in the UTV Platform, or caused by the use of the Services, or relating to the Services, or generated by the use of the Services, are owned by CMHK or relevant licensors and shall not be copied, transmitted, altered, edited or used in any other form for any purpose by the Users, failing which the Users shall be liable for all legal obligations.

7.3 The Users agree not to permit any third party to:

(i) use the Services in any unauthorized, fraudulent or illegal manner;

(ii) commit or permit any copyright or other intellectual property infringement;

(iii) use the Services for any unlawful, improper, obscene or defamatory purpose or any other purpose not permitted by CMHK;

(iv) interfere with or obstruct the Services, or do or omit to do anything that may have the effect of doing so;

(v) counterfeit, copy, print, sell, resell, distribute, publish or modify any part of the Services and its contents (including coding and software) without the written consent of CMHK;

(vi) use the services for commercial and non-private purposes;

(vii) prevent or restrict any person from using the Services, including harassing, intimidating and/or intruding into or disrupting any part of the Services;

(viii) use in a manner that may constitute an infringement of the rights of any other person by another user or by CMHK;

(ix) use the Services in any manner that may cause CMHK to violate any applicable law or regulation; or

(x) damage CMHK's goodwill or any other legitimate rights and interests.

7.4 The Users shall protect the information required to log in to their accounts and ensure that it is not disclosed or provided to any other person.

8. Suspension and Termination of Services

8.1 CMHK reserves the right to suspend or change the Services or terminate any User's access to the Services at any time. CMHK may suspend the provision of Services to the Users at any time for the purpose of system maintenance, upgrading, testing and/or repair without notice and no credit, refund or compensation is required.

8.2 CMHK may suspend, limit, terminate or revoke all or any part of the provision of Services at any time without compensation if:

(i) Any delay, loss, error or unrecognizable response in the UTV Platform arising out of or resulting from any technical interruption or error, network congestion or any other cause;

(ii) Any breach of the Terms and Conditions by the Users;

(iii) CMHK believes that providing the Service may cause CMHK or its affiliates to violate any applicable laws, guidelines and orders, instructions or requirements of government authorities;

(iv) CMHK has reasonable grounds to believe that the User is suspected of using the Service in an illegal or dishonest manner, including but not limited to infringement of any intellectual property rights, money laundering, terrorist financing, bribery, corruption, etc;

(v) Any breach of contract, tort or otherwise or any liability or obligation to any third party arising out of or in connection with the User's use of the Services;

(vi) CMHK ceases to provide related services; or

(vii) Any circumstances which CMHK considers necessary to protect its goodwill or any other legitimate rights and interests.

9. Limited warranty

9.1 To the fullest extent permitted by law, CMHK shall not make any representations, warranties or liabilities (whether express, implied or by any implication including but not limited to ownership of property rights or use etc.) in relation to:

(i) The Service is continuous and uninterrupted, timely, secure, trouble-free, and available for individual or independent use;

(ii) Any content or information provided, published, distributed, searched for or obtained accessible through the Service, or the results obtained from using the Service are accurate, reliable or meet the expectations of the Users. CMHK has no control over and assumes no responsibility for, any content transmitted through the Service;

(iii) any Services provided by any third party service provider related to the Service;

(iv) any data or information on the User alteration, loss or damage to the software and/or hardware pre-installed on the computer or device;

(v) Any direct or indirect income, profit or any consequential economic loss or any other loss suffered by the User or any third party due to any errors, interference or computer virus invasion on the User's computer system or device claim for compensation, or for any loss or damage caused by uploading, downloading or using any information, data, text, image, video or audio (including but not limited to damage to computer equipment or other equipment or any hardware or software, or infection by viruses or Trojan horses);

(vi) any claim for interference with or suspension of operation of any user's computer or device, or any part thereof;

(vii) any claim, loss or damage arising out of or resulting from an event of force majeure; and/or

(viii) any dispute, demand, claim, action, petition, damages, liability, loss or tort relating to (i) to (vii) above, or relating to any of the provisions of this clause, including, in particular, any infringement, dispute and/or claim relating to intellectual property rights.

9.2 The User agrees and undertakes to be solely responsible for any problems, disputes or consequences arising out of or in connection with the User’s or any end-user’s use of the Services, or any misuse, abuse or violation of the Terms and Conditions, or any problems or consequences arising out of any of the foregoing, during the use of the Services.

9.3 To the fullest extent permitted by law, CMHK makes no express and/or implied interpretation, or other forms of representations, warranties or undertakings, including but not limited to the quality, reliability, availability, merchantability, security, fitness for a general or particular purpose, legality, title or property rights, non-infringement of intellectual property rights or third party rights, authenticity and accuracy of any quality, level continuity of the Services and any related features and content. CMHK also has no liability for the nature, reputation and goodwill of third-party suppliers, etc. In particular, CMHK disclaims all liability of any kind for the accuracy or completeness of any information obtained through the Service. CMHK shall not be liable for any direct or indirect damages related to the Service, including but not limited to loss of data, information or otherwise, whether in the form of loss of voice, video or otherwise, as a result of any delay, failure or error in transmission or delivery, interference,  interruption or suspension of Service.

9.4 The User understands and agrees that CMHK shall not be liable for any loss or damage (whether direct or indirect) arising from any failure, interruption, delay or temporarily suspension of the Service due to power failure or other circumstances beyond the control of CMHK. CMHK shall also not be liable for any loss of data, revenue, income, actual or anticipated profits and business of the Users or any third party related to the Services, nor shall it be liable for any indirect, incidental, special, punitive or consequential loss or damage or similar loss.

9.5 The content of this part of the Service is provided under license from a third party and CMHK has no control over the content, nor does it guarantee the authenticity of the content and accept any liability for any losses, liabilities and compensations arising from the content.

9.6 The User expressly understands and agrees that the User's use of the Service is at the User's sole risk. The Service is provided on an "as is" and "as available" basis and CMHK expressly disclaims any express or implied warranties, including but not limited to suitability for a particular purpose and non-infringement of third parties' rights.

10. Disclaimer

10.1 If CMHK suspects that a User has:

(i) engaged in or been associated with unusual/suspicious activities;

(ii) used improper methods or fraudulent behaviors that have interrupted or interfered with any part of the Services, resulting in technical problems;

(iii) any dishonest behavior, provision of false or incorrect information; or

(iv) any violation of this clause or any other applicable laws or provisions.

CMHK shall have the final right to suspend or cancel any person from using the Service at its sole discretion without notice and without liability to such person and reserves the right to pursue such person.

10.2 Each Hong Kong mobile phone number can only use the Service with one supported device. If a User is found to be using this Service through plug-in programs or other informal means such as empty numbers or fake accounts or other means that affect fairness, CMHK will disqualify the User from using the Service without prior notice.

10.3 The Users agree to use the Service at their own risk. CMHK shall not be liable for or indemnify any User for any losses, injuries, expenses, costs, claim or actions (including but not limited to direct, indirect and consequential losses) arising out of the use of the Service.

10.4 The content or features provided by this service may vary from platform to platform.

10.5 This Service is only available for use in Hong Kong. This Service will not be available if an IP address from overseas is used or if the browser streaming is blocked. If the Service is used outside Hong Kong, any roaming data and all other costs incurred shall be borne by the User.

10.6 CMHK reserves the right to change the content of the Service, any channel, number of channels, channel combination, broadcasting hours of individual programs and content categories at any time and CMHK shall not be liable for any changes. The User agrees and confirms that any information and representations (including individual channels) provided by CMHK to the User at the time of the User’s subscription to the paid Service is not an undertaking to the User that the information and representation will necessarily be available throughout the period in which the paid service is in effect. The User agrees and confirms that if CMHK makes any of the above changes after the User subscribes to the Service, the User shall still be required to honour the minimum usage period committed to at the time of subscribing the Service (if applicable).

11. Third Party Advertising Content

11.1 CMHK has no control over the content of any third party links or advertising information embedded in the Service (the "Advertising Content"), and does not guarantee the authenticity of the Advertising Content. CMHK shall not be liable for any loss or damage of any kind incurred by the Users as a result of the Advertising Content.

11.2 CMHK may use third-party advertising companies to collect information about Users' use of this service (excluding the User's name, address, email address or phone number), in order to understand relevant promotional or advertising services and provide information of interest to the Users.

12. Interpretation and Amendment

12.1 To the maximum extent permitted by law, CMHK may change the Terms and Conditions at any time. CMHK will post the relevant changes on the websites of CMHK or UTV. The User's continued use of the Service shall represent the User's irrevocable acceptance of the changes. CMHK has the final and exclusive right of decision on any matters or disputes.

12.2 The User hereby agrees that CMHK has the right to refuse to provide account registration or cancel the use of the account for Users who in breach of the Terms and Conditions at its discretion.

14. Personal Data Protection

14.1 The User has read, understood and agreed to the provisions in the General Personal Information Collection Statement(Please click here) and the Privacy Policy Statement(Please click here)(collectively known as the "Statements"), and agrees to be bound by the provisions thereof.

14.2 The Statements are made in accordance with the Personal Data (Privacy) Ordinance (Cap. 486 of the laws of Hong Kong) (the "Personal Data (Privacy) Ordinance") to inform the User the purposes of collecting, processing, disclosing, retaining or using any User’s data which relating directly or indirectly to a living individual, from which it is practicable for the identity of the individual to be directly or indirectly ascertained and in a form in which access to or processing of the data is practicable (the "Personal Data") and expressly state that by continuing to use the Services, the User has conclusively demonstrated to have accepted and consented expressly and irrevocably to the usage of such information by CMHK and the rights conferred to CMHK

14.3 CMHK shall seek the consent of the User to use his Personal Data for direct marketing purposes. The User is requested to indicate his consent or objection to CMHK's use of his Personal Data regarding direct marketing purposes before providing his Personal Data.

14.4 The User is entitled to access or correct his Personal Data held by CMHK. If the User wishes to obtain a copy of any of his Personal Data or if he believes that any of his Personal Data which CMHK collects and maintains is inaccurate, please write to CMHK at the address below:

14.5 A request for access to or correction of User’s Personal Data, or for information regarding policies and practices of CMHK when collecting User’s Personal Data and kinds of personal data held by CMHK may be write to CMHK at the address mentioned in the Clause 14.4 herein. In accordance with the Personal Data (Privacy) Ordinance, CMHK have the right to charge a reasonable fee for the processing of any data access request.

15. General

15.1 These Terms and Conditions shall be governed by and construed with the laws of Hong Kong. All users agree that any action or claim arising out of these Terms and Conditions shall be subject to the exclusive jurisdiction of the Hong Kong courts.

15.2 Different parts of the Service may be governed by different Terms and Conditions. Accordingly, the Terms and Conditions and these additional terms and conditions will apply simultaneously and in the event of any discrepancy or inconsistency, the additional terms and conditions shall prevail.

15.3 CMHK reserves the right to change the Service content, terminate the Service and/or revise the Terms and Conditions at any time without prior notice.

15.4 Unless otherwise specified in these Terms and Conditions, the Contracts (Rights of Third Parties) Ordinance, Chapter 623 of the Laws of Hong Kong, shall not apply to these Terms and Conditions.

15.5 In the event of any dispute, the decision of CMHK should be absolute and final.

15.6 If there is any discrepancy between the Chinese and English versions of the Terms and Conditions, the English version shall prevail.

Terms and Conditions of the Service (“Terms and Conditions”)

  1. “UTV x Just English Improve jɔ:(r) English Course 365 Days Service” (“Just English Annual Service”) is provided by China Mobile Hong Kong Company Limited (CMHK).

Notice of Use

  1. Contents and services are only available to registered UTV App or UTV Box Users and subscribed to paid package. The Service is also available to Non-CMHK mobile service Users.
  2. Every User must (i) register as a UTV user, (ii) read and agree to the User Services Agreement to use the Service. By successfully subscribing and using the Service, User had read, agreed to and bound by these Terms and Conditions.
  3. The content of the Service are provided by “Just English Education Ltd.”.
  4. In addition to the Terms and Conditions herein contained, User agrees to the Terms and Conditions of “Just English Education Ltd”, and its related regulation of intellectual property. The Service is for individual use only and should not be used for other commercial purposes, or use in mobile devices other than the registered ones.
  5. User would only be qualified to use the Service after successfully purchasing the Service via the specified method provided in UTV (“specified channels”) according to the aforementioned methods (“qualified User”).
  6. The specified channel in includes payment via Alipay Hong Kong, Google and Apple In-App purchases in UTV App as well as payment via Alipay Hong Kong in UTV Box.
  7. User acknowledges and agrees that:
    1. After purchasing the Service on the UTV Box or UTV App, the order history and service usage rights will be automatically synchronized to another device after two working days.
    2. Data roaming or Wi-Fi network must be maintained while registering and using the Service on UTV App. The Service is only available during the normal operation of the mobile data network or Wi-Fi network. User acknowledges and agrees that the Service will not be accessed normally if the end-user is at a location where mobile data network or Wi-Fi network does not cover.
    3. Ethernet or Wi-Fi network must be maintained while registering and using the Service on UTV Box. The Service is only available during the normal operation of Ethernet or Wi-Fi network. User acknowledges and agrees that the Service will not be accessed normally if the end-user is at a location where Ethernet or Wi-Fi network does not cover.
    4. CMHK accepts no liability for any delay, loss, error or unrecognition in response, application or registration information submission, etc, for any reason, including but not limited to technical disruption or error, network congestion, connection problem or any other reasons or for inability to access the Service normally due to the aforementioned reasons.
  8. User agrees that he/she will not use the Service
    1. to carry out or allow any copyright or other intellectual property infringement;
    2. for any illegal, improper, obscene or defamatory purposes or any other purposes which we prohibit.
  9. The use of the Service by User is voluntary. CMHK accepts no legal liability or provides no damages for any loss, injury, cost, claim, litigation (including but not limited to direct, indirect and consequential loss) howsoever arising from any use of the Service.
  10. We make no warranty that
    1. The Service will meet user’s requirements;
    2. The Service will be uninterrupted, timely, secure or error-free;
    3. The results that may be obtained from the use of the Service will be accurate or reliable; or
    4. The quality of any service, information or other material obtained by user through the Service will meet his/her expectation.
  11. If User violates any law and rule, any term and condition herein contained or damages the rights of the third party, User consents to and undertakes to indemnify CMHK and render CMHK free from any damages for any claim and/or loss caused by his actions or his use of the Service.
  12. CMHK is entitled to cancel an User’s subscription of the Service, in its sole discretion, if CMHK suspects that the User (i) is undertaking or in connection with any unusual or suspicious activities, (ii) is using inappropriate method or committing fraud to interrupt operation and interfere any part of this Service, causing technical problems, or detects (iii) any dishonest conduct, false or inaccurate information provided or (iv) any breaches of these Terms and Conditions or any other applicable law or regulation, without notice or reason, and without any liability to any person.
  13. CMHK may, upon discovery or reasonable suspicion of suspected or inchoate behavior, against fraudulent, deceptive, unlawful, improper or immoral use of the Service by the Users, suspend or refuse Users' access to any or all of the Service temporarily or permanently.
  14. The Service is offered by third party supplier, User acknowledges and agrees that there is no connection between CMHK, “Just English Education Ltd” and its content suppliers. CMHK is not responsible for the control and guarantee of the goods, content or service, including but not limit to its quality, safety, suitability, legality, the realness and accuracy of content, legitimacy of intellectual property, goodwill and credibility of suppler, etc.
  15. Photos and descriptions about the Service are only intended to be for reference. All contents and services contained may vary.
  16. CMHK reserves the right to modify or terminate the Service, or revise the relevant Terms and Conditions without prior notice. CMHK shall publish these renewed Terms and Conditions on its website on a timely basis. If User continues using the Service, it shall be regarded conclusively that User accepts these amendments. The system record of CMHK shall be regarded as conclusive evidence in dealing with any matter and conflict.

  1. Service Content: User can watch the English teaching video content by the Just English team.
  2. Service Fee: $488
  3. Minimum Service Period: User shall be bound by 365 days starting from Service Effective Date 
  4. Service Effective Date: From the immediate date of order completion
  1. The Service Fee applies exclusively to User committed to Minimum Service Period.
  2. No automatic renewal payment is available for the Service.
  3. The video contents available in the Service may change from time to time without prior notice.
  4. No refund nor exchange can be made once the service fees are charged by CMHK and paid by Users.
  5. After service subscription, User can view the video contents on at most two supporting devices, including one mobile device and one UTV Box. The video contents in UTV App and the video contents in UTV Box may vary.
  6. The Service is only applicable in Hong Kong districts, non-Hong Kong IP address cannot access the Service.
  7. The Service shall be paid one-off for 365 days. Even if User does not actually use the Service for 365 days, 365 days’ service fee shall be collected.
  8. The Service does not include the data roaming fee.

Personal Information Collection Statement

  1. User consents to and is bound by the contents contained in the General Personal Information Collection Statement (Please click here) and the Privacy Policy Statement (Please click here) of CMHK.
    1. The personal information, including names, telephone numbers, email address, etc (if applicable), provided by user in the Service will only be used by CMHK for the relevant purpose of the Service. CMHK shall save and encrypt the relevant personal information and, according to the internal policies, erase the personal information. Just English Monthly Service

Terms and Conditions of the Service (“Terms and Conditions”)

  1. “UTV x Just English Improve jɔ:(r) English Course Service” (“Just English Monthly Service”) is provided by China Mobile Hong Kong Company Limited (CMHK).

Notice of Use

  1. The Service is only available to registered UTV Box Users.
  2. The Service is only available for user who has registered for designated China Mobile Hong Kong (“CMHK”) postpaid/corporate service plan; excluding CMHK user who has registered for prepaid/voice-only service plan, or who is the user of secondary SIM card/share plan’s supplementary SIM card. User must (i) register as a UTV user, (ii) read and agree to the User Services Agreement to use the Service. By successfully activating the Service, User had read, agreed to and bound by these Terms and Conditions.
  3. The content of the Service are provided by “Just English Education Ltd.”.
  4. In addition to the Terms and Conditions herein contained, User agrees to the Terms and Conditions of “Just English Education Ltd”, and its related regulation of intellectual property. The Service is for individual use only and should not be used for other commercial purposes, or use in mobile devices other than the registered ones.
  5. User would only be qualified to use the Service after successfully purchasing the Service via the specified method provided in UTV (“specified channels”) according to the aforementioned methods (“qualified User”).
  6. Specified channels include payment via telephone charge provided in the UTV Box.
  7. User acknowledges and agrees that:
    1. After purchasing the Service on the UTV Box or UTV App, the order history and service usage rights will be automatically synchronized to another device after two working days.
    2. Data roaming or Wi-Fi network must be maintained while registering and using the Service on UTV App. The Service is only available during the normal operation of the mobile data network or Wi-Fi network. User acknowledges and agrees that the Service will not be accessed normally if the end-user is at a location where mobile data network or Wi-Fi network does not cover.
    3. Ethernet or Wi-Fi network must be maintained while registering and using the Service on UTV Box. The Service is only available during the normal operation of Ethernet or Wi-Fi network. User acknowledges and agrees that the Service will not be accessed normally if the end-user is at a location where Ethernet or Wi-Fi network does not cover.
    4. CMHK accepts no liability for any delay, loss, error or unrecognition in response, application or registration information submission, etc, for any reason, including but not limited to technical disruption or error, network congestion, connection problem or any other reasons or for inability to access the Service normally due to the aforementioned reasons.
  8. User agrees that he/she will not use the Service：
    1. to carry out or allow any copyright or other intellectual property infringement;
    2. for any illegal, improper, obscene or defamatory purposes or any other purposes which we prohibit.
  9. The use of the Service by User is voluntary. CMHK accepts no legal liability or provides no damages for any loss, injury, cost, claim, litigation (including but not limited to direct, indirect and consequential loss) howsoever arising from any use of the Service.
  10. We make no warranty that:
    1. The Service will meet User’s requirements;
    2. The Service will be uninterrupted, timely, secure or error-free;
    3. The results that may be obtained from the use of the Service will be accurate or reliable; or
    4. The quality of any service, information or other material obtained by User through the Service will meet his/her expectation.
  11. If User violates any law and rule, any term and condition herein contained or damages the rights of the third party, User consents to and undertakes to indemnify CMHK and render CMHK free from any damages for any claim and/or loss caused by his actions or his use of the Service.
  12. CMHK is entitled to cancel an User’s subscription of the Service, in its sole discretion, if CMHK suspects that the User (i) is undertaking or in connection with any unusual or suspicious activities, (ii) is using inappropriate method or committing fraud to interrupt operation and interfere any part of this Service, causing technical problems, or detects (iii) any dishonest conduct, false or inaccurate information provided or (iv) any breaches of these Terms and Conditions or any other applicable law or regulation, without notice or reason, and without any liability to any person.
  13. CMHK may, upon discovery or reasonable suspicion of suspected or inchoate behavior, against fraudulent, deceptive, unlawful, improper or immoral use of the Service by the Users, suspend or refuse Users' access to any or all of the Service temporarily or permanently.
  14. The Service is offered by the third party supplier, User acknowledges and agrees that there is no connection between CMHK, “Just English Education Ltd” and its content suppliers. CMHK is not responsible for the control and guarantee of the goods, content or service, including but not limit to its quality, safety, suitability, legality, the realness and accuracy of content, legitimacy of intellectual property, goodwill and credibility of suppler, etc.
  15. Photos and descriptions about the Service are only intended to be for reference. All contents and services contained may vary.
  16. CMHK reserves the right to modify or terminate the Service, or revise the relevant Terms and Conditions without prior notice. CMHK shall publish these renewed Terms and Conditions on its website on a timely basis. If User continues using the Service, it shall be regarded conclusively that User accepts these amendments. The system record of CMHK shall be regarded as conclusive evidence in dealing with any matter and conflict.

this Supplementary Agreement

  1. The Service Fee applies exclusively to User committed to Minimum Service Period.
  2. Automatic renewal payment is available for the Service.
  3. The video contents available in these Service may change from time to time without prior notice.
  4. No refund nor exchange can be made once the service fees are charged by CMHK and paid by User.
  5. After service subscription, User can view the video contents on at most two supporting devices, including one mobile device and one UTV Box. The video contents in UTV App and the video contents in UTV Box may vary.
  6. The Service is only applicable in Hong Kong districts, non-Hong Kong IP address cannot access the Service.
  7. The Service shall be paid in advance and on monthly basis. Service period less than 1 month will be charged on a full month basis.
  8. The Service does not include the data roaming fee.

Personal Information Collection Statement

  1. User consents to and is bound by the contents contained in the General Personal Information Collection Statement (Please click here) and the Privacy Policy Statement (Please click here) of CMHK.

The personal information, including names, telephone numbers, email address, etc (if applicable), provided by User in the Service will only be used by CMHK for the relevant purpose of the Service. CMHK shall save and encrypt the relevant personal information and, according to the internal policies, erase the personal information. In case where User has effected prepayment, all service charges and other fees paid by User by way of prepayment shall be liable to be forfeited as liquidated damages and in no circumstances shall they be refunded or transferred and any unused rebates, credits or benefits accrued to the service plan attached to the Mobile Number stated in this Agreement shall forthwith cease to be payable without compensation. Nor may any such unused rebates, credits or benefits be carried forward to other accounts or redeemed for cash or any item or product.
    1. if User changes the registered name for the mobile telephone number, or
    2. if the service to the mobile telephone number is terminated / disconnected for whatever reason, or
    3. if this Supplementary Agreement and/or “The (General) Contract for Telecommunications Services” (“General Contract”) is terminated for whatever reason, or
    4. if the Service is suspended/terminated for whatever reason.
