MyLink Points Terms and Conditions

MyLink App (“MyLink”) is operated and managed by China Mobile Hong Kong Company Limited (“CMHK”). MyLink users (“Users”) may make use of different methods to earn MyLink Points (“Points”) in order to exchange for different rewards, products or services. Points usage is subject to the terms and conditions hereof and other relevant terms and conditions which are announced or notified by CMHK through different means of communication.

1. Earning Points

1.1 Users can earn Points through relevant Points collecting campaigns announced on MyLink, the website, online shop; retail stores or customer service hotline(s) of CMHK , or through the example methods in MyLink below (where “week” is from Monday to Sunday and “month” is from the 1st to the last day of each month):

CMHK can adjust the method of earning Points and the corresponding Points given on MyLink at any time without prior notice. If the above method of earning points is cancelled, it will be announced within 30 working days.

1.2 The Points cannot be returned, exchanged for cash, replaced, refunded, sold, divided, , assigned or transferred to others (except for specific events, which will then be subject to the terms and conditions of the specific event). Points stored in different accounts cannot be used in combination. All unused Points of the User will be forfeited when his or her MyLink account is closed.  

1.3 The validity period of the Points is subject to the time when the Points are credited into the Users’ MyLink account. Notwithstanding any information regarding the validity of Points published on MyLink accounts or through other materials, Users shall take the information shown on their MyLink accounts as accurate. In case of discrepancy, the information contained on MyLink shall prevail. Users shall arrange the redemption accordingly.

1.4 Users should use the Points before expiry for online payment, prepaid card refill, and/or redeem rewards or purchase specified products/services. Once the Points expire, they  will not be reissued or extended.

1.5 CMHK reserves the right in handling the Users’ Points at its sole discretion and determination.  Under the following circumstances, MyLink reserves the right to deduct or withhold the issuance of any Points to any Users’ account without notice (including but not limited to): 

(a)in the case of Users’ actual or suspect fraud;

(b)Users earn Points by unfair means (including but not limited to dishonest use, deception, misuse or abuse);

(c)cancellation, reversal or refund of any relevant service plans or mobile service plans by the Users;

(d) miscalculated or inaccurate crediting of Points to any Users’ account by MyLink or by other service providers; and/or

(e)any case where CMHK reasonably exercises the above right to ensure that the User is earning Points properly.

1.6 The User shall be fully responsible for any loss of Points and rights arising from the unauthorized use or loss of the User’s account or Points.

1.7 Wherein the User has exchanged, used or transferred Points of other Users, CMHK reserves the right to:

(a)Charge the User for the exchanged product/service at the suggested retail price;

(b)Charge the User for the value of the Points at the bank exchange rate; or

(c)Act in accordance to the combining effects of the above.

2.Online Payment for Points or for Prepaid Cards

2.1 Users may use their Points to pay for their monthly service plans or for prepaid card refill before the expiry of the Points. Every HK$1 can be exchanged for 100 points.

2.2 Users may take the following steps to make bill payments or prepaid card refills:

(i)select the Points Payment Mode on the MyLink Payment/Refill page;

(ii)customize/use a fixed amount of Points to offset the payment amount; and;

(iii)read carefully and confirm the terms and conditions of the MyLink Payment/Refill, and click Pay Now Refill Now.

2.3 The Points that have been used to offset the payment amount will be deducted from the User's MyLink account, and cannot be refunded, varied or changed.

2.4 The current Points payment methods for monthly service plans include (1) pure point payment; (2) pure cash payment; and (3) cash and point payment. For payment by cash or by Points purchased by cash, please  refer to the online payment methods provided on MyLink .

3.Redemption of Points Rewards

3.1 Users may use unexpired Points to redeem rewards. Points will be utilized on a first-in-first-out basis. Redemption of Points Reward is subject to users having adequate Points and is subject to stock availability, which will be based on a first come, first served basis.

3.2 If the Points are insufficient to redeem the particular reward, the application will not be accepted.

3.3 Users can redeem Points Rewards through the following steps:

(i)Select Points Rewards under “MyLink Points” and click “Redeem”; and

(ii)Read carefully and confirm Rewards’ terms and conditions. Then click “Redeem Now” and fill in your delivery address (if required).

3.4 Users shall be responsible for ensuring all relevant data provided by them (which include, but not limited to personal information, delivery address, and contact details, etc.) is complete, updated, true and accurate. If CMHK fails to fulfill its responsibilities and/or obligations or fails to fulfill them on time, or any other circumstances occurred, due to the incomplete, outdated, inaccurate and/or misleading data submitted by Users during the redemption process, CMHK shall not be liable for the aforementioned failure. Users hereby undertakes to indemnify and hold CMHK harmless against all costs, losses and damages resulting from the incomplete, outdated, inaccurate and/or misleading data during the redemption.

3.5 Where User's redemption fails due to system network problem or other causes, CMHK shall not be held liable in any manner.

3.6Rewards ’photos displaying on MyLink are for reference only and shall not constitute or be construed as giving any understanding, representation or warranty.

3.7All rewards are subject to availability. No prior notice of termination of the redemption of rewards nor rewards’ inventory status will be given by MyLink.

3.8The Points used in payment redemption cannot be refunded, exchanged or cash back.

4.Product Delivery

4.1 Delivery:Non-service reward products will be delivered to Users via designated courier services or via Hong Kong Post within 7 working days after the redemption process has been successfully processed. The order shall be deemed as completed when CMHK dedicates to designated courier services or Hong Kong Post for the said delivery and no guarantee as to the delivery date and time will be given by CMHK. CMHK shall not be held responsible for any delayed delivery. MyLink reserves the right to cancel the redemption and to return the Points to Users due to stock unavailability.

4.2 Pickup at CMHK's Designated Outlets:Users must collect the ordered product(s) as required by CMHK at the designated CMHK shop within 14 days (unless CMHK otherwise specified a specific time limit) after completion of Ordering Process at MyLink app, failing which, CMHK is entitled to cancel the order. Users shall be deemed to have abandoned the ordered goods and the CMHK is entitled to dispose the said Items in any manner it thinks fit without accountable to the Customer for any refund, or any loss and/or damages.

4.3 Users are required to examine the products immediately upon delivery for any deficiencies and/or damages and whether all the accessories have been delivered. If the products are damaged during the delivery process, Users should reject receiving the products and contact CMHK’s customer service.

4.4 As designated rewards are provided by third party suppliers, the usage of such rewards is therefore bound by third party suppliers ’relevant terms and conditions. If Users have any enquiries or complaints about the rewards, please contact the suppliers directly. CMHK shall not be responsible for any disputes arising from the rewards.

5.Personal Data and Privacy Protection

5.1 MyLink will only collect and use Users’ personal data, including but not limited to the names, email addresses, and delivery addresses of the Users, for MyLink Points purchase, online payment, prepaid card refill, rewards redemption, registration and reward products pick up or delivery as requested by Users. Where necessary, MyLink will also send Users’ personal data to third party service providers for the purpose of pick up or delivery arrangements.

5.2 MyLink shall keep Users’ personal data strictly confidential in accordance with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong).

5.3 The provision of personal data is entirely voluntary. However, if Users choose not to provide their personal information, MyLink may not be able to provide relevant information or services, or to process Users’ requests.

5.4 CMHK will treat Users' personal data confidentially at all times, and destroy Users’ personal data in accordance with internal policies. Except for reasons to comply with statutory or contractual obligations or to investigate, detect crimes, prosecute suspects etc. CMHK will only retain personal data for as long as it required. 6.Limitation of Liability

6.1 The User acknowledges, agrees and accepts the risk of Points exchange. CMHK shall not be liable for any direct, indirect, incidental, corresponding or punitive damages, or any damages for loss of profits or income of the User arising from the User’s Points.

6.2 To the extent permitted by law, all news, information, rewards and/or redeemed goods and/or services provided in relation to Points are provided in the "as is" manner without any express or implied warranties or representations, including but not limited to any related ownership, satisfactory quality, merchantability, fitness for a particular purpose, suitability, privacy or non-infringement, or that they will be free of errors, can be used and/or any errors or faults will be corrected by express or Implied warranty or express or implied terms.

6.3 To the extent permitted by law, CMHK shall not be responsible or liable for any loss or injury caused by any of the following: any rewards and/or services provided by Users’ Points redemption; or any performance failure, error, omission, interruption, deletion, defect, operation or transmission delay, computer virus, telecommunications line failure, online information theft during transmission, software or hardware problems (including but not limited to data loss or compatibility issues) ; any damage or injury arising from theft, whether based on breach of contract, tort, negligence, omission, liability and/or any other cause of action (whether caused by CMHK and/or third-party service providers).

6.4 Without prejudice to other provisions of these Terms and Conditions, where CMHK’s liabilities, in regard to the User's relevant Points (including the use of Points and/or redemption of rewards, etc.), cannot be exempted or limited as per applicable laws, such liabilities shall be limited to the return of the Points and/or the cost of redeeming rewards to Users during the relevant period, and are determined at the absolute discretion of CMHK.

7. Intellectual Property

The components of communication materials of MyLink (including but not limited to printed materials and MyLink), including text, graphics, logos, trademarks and photographs, are protected by Hong Kong and international copyright laws. They should not be reproduced or used without express permission of CMHK. It is hereby agreed and acknowledged that all intellectual property rights relating from such trademarks and/or images, or the use thereof, shall remain vested in CMHK.

8.Other Terms

8.1 CMHK is dedicated to ensure the contents and product descriptions of rewards are accurate and complete, however no guarantee on all the contents and product descriptions on MyLink are accurate, complete, updated and error free will be given. CMHK shall not be liable for any loss or damage of any kind incurred as a result of inaccurate information posted on MyLink.

8.2 All offers, facilities, special offers, incentives and services of CMHK may be affected by the availability of the goods/services and may be changed at any time without notice.

8.3 If the User violates or CMHK has reasonable grounds to believe that the User violates these Terms and Conditions, CMHK may suspend or terminate the User’s MyLink account, and/or take action to recover any loss of CMHK and/or our partners and/or third-party service providers arising out of and/or involving the Users’ breach.

8.4 If for any reasons including computer system virus infection, defect, tampering, unauthorized interference, fraud, technical failure or any other reason beyond the control of CMHK, the safety, impartiality, or completeness of the Points operation system or the normal operation of this project is so affected, CMHK reserves the right to take any feasible action at its absolute discretion.

8.5 The User clearly understands and agrees to:

Bear the risks and consequences of using the MyLink service and earning Points provided by CMHK; the services are provided by CMHK on "as is" basis to the maximum extent permitted by law, but does not provide any kind of express or implied guarantee. CMHK does not recognize all warranties, express or implied, including any warranties for merchantability,  fitness for a particular purpose, suitability, and non-infringement. CMHK cannot guarantee that:

(a) Points can meet your requirements;

(b) Points can be uninterrupted, timely, safe or without errors;

(c) The results provided via MyLink are absolutely true or reliable;

(d) Any products, services, information or other purchased goods or materials obtained through MyLink can meet your expectations; or

(e) All errors in MyLink can be corrected.

8.6 CMHK reserves the right to change, increase, decrease and cancel the amount of Points in each User's MyLink account without individual notice.

8.7 CMHK reserves the right to, from time to time, modify or update any information, rewards available for redemption, Points earning rate  and/or redemption progress on MyLink without notice.

8.8 CHMK assumes no responsibility for any claims, losses, costs, expenses or damages of whatever nature resulting from the redemption of the rewards.

8.9 Anyone who is not a party to this Terms and Conditions shall have no  rights under the Contract (Third Party Rights) Ordinance, (Cap 623) to enforce these Terms and Conditions or enjoy rights under any of the Terms and Conditions.

8.10 If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, such invalidity and unenforceability shall not affect the remainder of the Terms and Conditions, which shall continue in full force and effect.

8.11 The Terms and Conditions set out herein are governed by the laws of Hong Kong Special Administrative Region, and the Users agree to submit to the exclusive jurisdiction of the Hong Kong courts.

8.12 In case of any dispute, CMHK reserves the right of final decision.

8.13 If there is any discrepancy between the English and Chinese versions of the Terms and Conditions, the English version shall apply and prevail.
